Riyadh Court Delays Abdul Rahim's Release for Fifth Time

The Riyadh Criminal Court has postponed the release of Abdul Rahim, a native of Feroke, Kozhikode, for the fifth time, prolonging his 18-year incarceration in Saudi Arabia. Despite the commutation of his death sentence on July 2, Rahim's release remains stalled due to unresolved public offense charges.

Abdul Rahim, formerly an autorickshaw driver in Kerala, moved to Saudi Arabia in 2006 seeking better employment opportunities. He secured a position as a driver in Riyadh, where he was also tasked with caring for his employer's differently-abled son, Fayez. Tragically, during a car journey, a medical device essential for Fayez's breathing became dislodged, leading to the boy's death. Although the incident was accidental, Rahim was charged with murder under Saudi law and sentenced to death in 2018. This verdict was upheld by the appellate court in 2022 and later ratified by the Supreme Court.

In a bid to save Rahim from execution, a substantial compensation amounting to 1.5 crore Saudi riyals (approximately ₹34 crore) was raised through extensive fundraising efforts by the Malayalee community and other well-wishers. The victim's family accepted this blood money, leading to the commutation of Rahim's death sentence on July 2. However, his release has been repeatedly delayed due to pending legal procedures related to public offense charges.

The first hearing concerning Rahim's release was scheduled for October 21 but was adjourned due to a change in the judicial bench overseeing the case. Subsequent hearings on November 17 and December 8 also concluded without a definitive verdict, as the court required additional time for thorough examination. The latest hearing, which took place on December 29, ended with the court announcing the need for further scrutiny at all levels before issuing a verdict, marking the fifth postponement in this protracted legal battle.

Rahim's legal representative, Osama Al Amber, along with officials from the Indian Embassy and family representatives, have been actively involved in the court proceedings. Despite their concerted efforts, the complexities of Saudi legal procedures concerning public rights have contributed to the delays in Rahim's release. The Indian Embassy in Riyadh has reportedly arranged all necessary travel documents to facilitate Rahim's return to India once the release order is sanctioned.

The prolonged detention of Abdul Rahim has elicited significant concern among his family members and the broader community in Kerala. His family, residing in Feroke, Kozhikode, has been anxiously awaiting his return, expressing hope that the legal hurdles will soon be resolved.
